Terms of Service

By accessing or using MoltCloud ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the Service.

MoltCloud is a cloud hosting platform that provides infrastructure for running Moltbot instances. We provide:

• Virtual machine hosting for Moltbot software
• Network connectivity and bandwidth
• Management dashboard and configuration tools
• Technical support for platform-related issues

3.1 Third-Party Software

Moltbot is an open-source software project developed independently of MoltCloud. We do not develop, maintain, or control the Moltbot software. Your use of Moltbot is subject to its own license terms available at github.com/moltbot/moltbot .

3.2 No Warranty for Moltbot

We make no representations or warranties about the Moltbot software itself, including its functionality, reliability, security, or fitness for any particular purpose. Moltbot is provided "AS IS" by its developers.

4.1 Your AI Provider Relationships

To use AI functionality within Moltbot, you must maintain your own subscriptions or API access with third-party AI providers (such as Anthropic, OpenAI, or others). You are solely responsible for:

• Obtaining and maintaining valid API keys or subscriptions
• Complying with each AI provider's terms of service and acceptable use policies
• All fees charged by AI providers for API usage
• Understanding and accepting the capabilities and limitations of AI models

4.2 No Liability for AI Provider Issues

MoltCloud is not responsible for any issues arising from your use of third-party AI providers, including but not limited to:

• Service outages or API unavailability
• Changes to pricing, terms, or functionality
• Content generated by AI models
• Account suspensions or terminations by AI providers
• Data handling practices of AI providers

4.3 AI-Generated Content

You acknowledge that AI-generated content may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing and using AI-generated content appropriately. MoltCloud has no control over and assumes no responsibility for AI-generated content.

Moltbot supports integration with various messaging platforms (WhatsApp, Telegram, Discord, Slack, Signal, iMessage, etc.). You are responsible for:

• Complying with each platform's terms of service and API policies
• Obtaining necessary authorizations to use automated messaging
• Ensuring your use does not violate platform rules or applicable laws

MoltCloud is not affiliated with any messaging platform and is not responsible for any account restrictions, bans, or other actions taken by these platforms.

You agree to:

• Use the Service in compliance with all applicable laws and regulations
• Maintain the security of your account credentials and API keys
• Not use the Service for any illegal, harmful, or abusive purposes
• Not attempt to circumvent resource limits or abuse platform resources
• Not use the Service to send spam or unsolicited messages
• Be responsible for all activity that occurs under your account

You may not use MoltCloud for:

• Any illegal activities or to facilitate illegal activities
• Harassment, abuse, or harm to others
• Distribution of malware or malicious content
• Spamming or unsolicited bulk messaging
• Impersonation or fraud
• Circumventing security measures
• Activities that violate the rights of others
• Any use prohibited by AI provider terms of service

8.1 Billing

Paid features are billed in advance on a subscription basis. You agree to pay all fees associated with your subscription plan.

8.2 Cancellation

You may cancel your subscription at any time. Upon cancellation, your service will continue until the end of the current billing period, after which your Moltbot instances will be terminated.

8.3 Refunds

Subscription fees are generally non-refundable. Exceptions may be made at our sole discretion.

9.1 Service Provided "AS IS"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.2 No Liability for Third-Party Services

MOLTCLOUD SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, OR ISSUES ARISING FROM:

• The Moltbot software or its functionality
• Third-party AI providers or their services
• Third-party messaging platforms or their policies
• Content generated by AI models
• Actions taken by third parties based on AI-generated content

9.3 Limitation of Damages

IN NO EVENT SHALL MOLTCLOUD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless MoltCloud and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your use of AI services or messaging platform integrations
• Content generated or transmitted through your Moltbot instance

We strive to maintain high availability but do not guarantee uninterrupted service. We may suspend or terminate the Service at any time for maintenance, security issues, or other operational reasons.

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service immediately ceases.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
